By accessing or using Worth Living ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Worth Living is a digital platform designed to support Dialectical Behavior Therapy (DBT) practice. The Service includes:
- Digital diary card tracking
- Homework and worksheet management
- Progress tracking and analytics
- AI-powered pattern analysis (for coaches)
- Team collaboration tools
3. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Ensuring compliance with all applicable laws and regulations
4. Professional Use
For Coaches: By using Worth Living as a coach or therapist, you represent that you:
- Are a licensed mental health professional or qualified DBT practitioner
- Will use the Service in compliance with applicable professional standards
- Understand that the Service is a tool to support, not replace, professional judgment
- Are responsible for all clinical decisions and client care
For Clients: The Service is designed to support your therapy but is not a substitute for professional mental health treatment.
5. Medical Disclaimer
Worth Living is a General Wellness Product under FDA guidelines. The Service:
- Is NOT a medical device
- Is NOT intended to diagnose, treat, cure, or prevent any disease
- Does NOT provide medical advice or emergency services
- Should NOT be used in place of professional medical care
If you are experiencing a mental health emergency, call 988 (US), 999 (UK), 112 (EU), or your local emergency services immediately.
6. HIPAA Compliance
For covered entities under HIPAA, we offer Business Associate Agreements (BAA) with paid plans. The BAA governs:
- How we handle Protected Health Information (PHI)
- Security measures and breach notification procedures
- Your rights and our obligations under HIPAA
- Data retention and deletion policies
7. AI Features and Data Use
Our AI-powered analysis features:
- Only process de-identified numerical data (emotion ratings, urge ratings, skills used)
- Never access names, dates, personal notes, or any identifying information
- Generate insights based on patterns in aggregated data
- Are provided as suggestions to support, not replace, clinical judgment
8. Acceptable Use Policy
You agree not to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Transmit malicious code or attempt to breach security
- Harass, abuse, or harm others
- Use the Service for any unlawful purpose
- Share your account with unauthorized users
- Attempt to reverse engineer or copy the Service
9. Subscription and Payment
Paid subscriptions are billed in advance on a recurring basis. You agree that:
- Fees are non-refundable except as required by law
- You authorize us to charge your payment method
- You will update your payment information if it changes
- We may change pricing with 30 days notice
- Annual plans offer a discount over monthly billing
10. Termination
We may terminate or suspend your account immediately, without prior notice, for:
- Breach of these Terms
- Fraudulent or illegal activity
- Non-payment of fees
- Violation of our Acceptable Use Policy
Upon termination, your right to use the Service will immediately cease. You may request a data export within 30 days of termination.
11. Limitation of Liability
To the maximum extent permitted by law, Worth Living shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use or inability to use the Service.
12. Indemnification
You agree to indemnify and hold Worth Living harmless from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or violation of any rights of another.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
